TERMS & CONDITIONS
These Terms & Conditions apply to all Anakata expeditions, including private charters. Our Booking Terms and Privacy Policy form part of them. For private charters, the signed Charter Agreement prevails where it sets different terms. By accepting these Terms at booking, you accept them for every guest in your booking.
1. Who we are
Anakata expeditions are sold by Pontos LLC, a company registered in Delaware, USA, doing business as Anakata ("Anakata", "we", "us"), which issues all invoices and receives all payments. The yacht is operated in Ecuador by LUMABEDA TOURS C. LTDA., which holds the Galápagos National Park (DPNG) operating permit.
2. Your booking
2.1 Your booking is confirmed once we receive your deposit and send you a Booking Confirmation & Invoice.
2.2 In a private charter, the person or company signing the Charter Agreement is responsible for all guests in the charter party.
2.3 If you book through a travel advisor, your advisor acts on your behalf. Your contract is with Anakata.
3. Prices
3.1 Prices are in US dollars, for 7-night or 14-night expeditions, Saturday to Saturday from San Cristóbal (SCY). Cabin prices are per person based on double occupancy; charter prices are per yacht for up to 16 guests; if a charter carries fewer than 16 guests, there is no reduction in the charter price. Each expedition is priced at the rate of its embarkation year.
3.2 Adjustments, as shown in our current rate sheet:
- Single occupancy: +75% on regular departures and 100% on Christmas and New Year (Festive) departures. Triple occupancy: reduced rate, in selected suites only.
- Children aged 6 to 17: 15% discount, up to one per adult and two per family.
- 14 nights (back-to-back or 14-night charter): 5% discount on the second week. This discount does not apply for weeks that fall into one of the two festive departure weeks.
- Christmas and New Year (Festive) departures (this is when the yacht departs and/or sails on the night of 24 or 31 December): a supplement per guest or per charter is included in the holiday rate. Special payment and cancellation terms apply, as set out in the Booking Terms. Child and 14-night discounts do not apply.
3.3 The price shown in your Booking Confirmation is guaranteed once your deposit is received, except for (a) changes in government fees, park entry fees, taxes or charges outside Anakata's control, (b) obvious pricing errors, which we will notify you of before your balance is due or promptly upon discovery, and (c) changes you request to your booking, which are priced at the rate applicable to the new departure.
4. Payment methods
4.1 Credit/debit cards (Visa, Mastercard and American Express) and wire transfer are accepted. For private charters, only wire transfer is accepted.
4.2 Card deposits are charged at the time of booking. Cabin deposits paid by wire transfer must be received within five days of booking, and the booking is held until then. Private charter payments follow the Booking Terms and the Charter Agreement. Please include your booking reference (ANK-YYYY-NNNN). Bank charges are the responsibility of the sender.
5. Changes
5.1 Date changes: not permitted. A request to change dates is treated as a cancellation, followed by a new booking at the rate in force. Anakata may, at its sole discretion and in writing, agree to an exception.
5.2 Name changes: a guest may be replaced by another person at no charge before the final payment is due. Any resulting supplier charges are added to the booking.
5.3 Unpaid balance: we send reminders 21 and 7 days before the final payment is due. If it is not received by the due date, our team will contact you, and Anakata may cancel the booking. The cancellation charges in the Booking Terms then apply.
6. Cancellations and refunds
6.1 Cancellations must be sent in writing to reservations@anakata.co (direct bookings) or advisors@anakata.co (bookings made through a travel advisor), and take effect on the date we receive them.
6.2 Failure to arrive in time for departure is treated as a cancellation.
6.3 Refunds are made to the original form of payment within 15 business days of the cancellation date. Any fees deducted by the bank or card processor are not refunded.
6.4 If Anakata cancels a departure, section 9 applies.
7. What's included
Accommodation, all meals, open bar (house wines, beers, spirits and soft drinks), guided excursions with certified naturalist guides, snorkeling gear, kayaks and paddle boards, the wellness center, and airport transfers in San Cristóbal on embarkation and disembarkation days. Not included: international and domestic flights, the Galápagos National Park entrance fee and Transit Control Card (TCT), hotels, spa treatments, premium drinks, purchases in the boutique, travel insurance and gratuities. We can arrange flights, park fees, hotels and extensions at an additional cost, subject to each supplier's conditions.
8. Travel documents
Each guest needs a passport valid for at least 6 months from the arrival date to Ecuador. Citizens of some countries require a visa to enter Ecuador. Anakata does not process any visas for its clients.
Passenger information provided to Anakata must match the passport exactly. It is due with the final payment and is required for the DPNG passenger list. Every guest must sign our Transportation Agreement before embarkation.
9. Itinerary, schedule and yacht changes
9.1 Anakata may, at its sole discretion and without liability, deviate from the advertised schedule or itinerary without prior notice, for reasons including weather, sea conditions, health and safety, changes to Galápagos National Park policies, mechanical problems, refueling, provisions or supplies. Anakata is not responsible for any loss, damage or inconvenience resulting from such changes.
9.2 The first and last days of each expedition are mainly logistical and depend on flight and refueling schedules. Visits on those days are not guaranteed, and no refunds, discounts or credits are given if no visits take place.
9.3 Anakata may cancel, change, advance or postpone a scheduled departure, or change the airport, port, itinerary, islands, visitor sites, yacht or means of transport, for reasons including weather, health and safety, charters, low occupancy, mechanical or maintenance issues, refueling, provisions or the requirements of government authorities. If Anakata cancels your expedition, before or during it, for reasons within its control, such as charters, low occupancy, or mechanical or maintenance issues, you may choose a refund of the amounts paid for the unused portion of the expedition or a transfer to another departure, subject to availability and any applicable price difference. If the cancellation is due to circumstances beyond Anakata's reasonable control, such as weather, sea conditions or the requirements of government authorities, section 9.6 applies.
9.4 The yacht may be called upon to assist other vessels, tow or be towed, or deviate from its route to save life or property, and Anakata will do so without any liability to guests.
9.5 Anakata may replace the yacht with another vessel of similar category for reasons including force majeure, mechanical problems or safety. No refund or other compensation is given to guests who accept the replacement vessel. Guests who do not accept it will receive a refund of the amounts paid to Anakata for the expedition, and Anakata will not be liable for any other costs, including non-refundable airline tickets.
9.6 Anakata will not be liable for any failure or delay in performing its obligations, or for any resulting expenses, losses or damages, to the extent caused by circumstances beyond its reasonable control that could not reasonably have been prevented or avoided, including events of force majeure or fortuitous events, such as natural disasters, extreme weather, pandemics, war, port closures or binding government restrictions. Anakata may modify, suspend or cancel the affected expedition or services and will notify you as soon as reasonably practicable and take reasonable steps to mitigate the impact. If a departure is cancelled, interrupted or postponed for any of these reasons and no substitute vessel can be arranged, Anakata will issue a credit for the unused portion of the expedition, to be used on a future departure, subject to availability.
10. Children and minors
10.1 Guests must be at least 6 years old, except on private charters. Children under 12 must share a suite with an adult. Anakata does not provide childcare; an adult must supervise each child at all times.
10.2 Guests under 18 must travel with a parent or legal guardian, who accepts these Terms on their behalf and shall be liable for any loss, damage or injury caused by the minor's acts or omissions.
11. Health
Galápagos is a remote destination with limited medical facilities. Guests must tell us at booking about any medical condition relevant to their safety. The Captain may refuse embarkation, or disembark a guest, where their health or conduct puts themselves or others at risk. No refund is due in that case. Guests who will be 30 or more weeks pregnant at any time during the expedition may be refused embarkation. Pregnant guests must inform us at booking, may be asked for a medical certificate and must sign our Pregnancy Waiver.
12. Travel insurance
Health and medical evacuation insurance is mandatory for every guest: at least USD 100,000 for medical expenses and USD 100,000 for evacuation, including air evacuation from Galápagos and pre-existing conditions. Proof may be requested 120 days before departure; a guest without it may be refused embarkation. Cancellation and baggage insurance is strongly recommended.
13. Conduct
Guests must follow the instructions of the Captain, crew and naturalist guides, and all Galápagos National Park regulations. Guests are responsible for any damage to the yacht, equipment or other property caused by their negligent or intentional acts or omissions.
14. Liability
To the extent permitted by applicable law, Anakata is not liable for indirect or consequential losses, loss of profit, expenses relating to independently booked travel arrangements, or acts or omissions of third-party providers for whom we are not legally responsible. Anakata is not liable to the extent that loss, injury or damage is caused by a guest's acts or omissions, including failure to follow safety instructions, disclose a medical condition relevant to their safety, or comply with travel documentation and entry requirements. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Guests are liable for any loss, damage or injury caused by their acts or omissions and shall reimburse Anakata for all resulting costs and expenses, including reasonable repair costs and third-party claims.
The charter client shall be liable for any loss, damage or injury caused by the acts or omissions of any member of the charter party and shall reimburse Anakata for all resulting costs and expenses, including reasonable repair costs and third-party claims.
15. Privacy
We process personal data in accordance with our Privacy Policy.
16. Governing law
16.1 These Terms are governed by the laws of Ecuador.
16.2 The parties expressly agree that any dispute arising out of or relating to these Terms, including their validity, interpretation, performance or termination, shall be resolved by confidential arbitration administered by the Arbitration and Conciliation Center of the Guayaquil Chamber of Commerce (Centro de Arbitraje y Conciliación de la Cámara de Comercio de Guayaquil) under its Arbitration Rules and Ecuador's Arbitration and Mediation Law. A sole arbitrator, appointed by drawing lots, shall decide the dispute in accordance with law. The expedited procedure under Articles 65 et seq. of those Rules shall apply regardless of the amount or complexity of the dispute. The seat of arbitration shall be Guayaquil, Ecuador, and the proceedings shall be conducted in Spanish.
16.3 The parties expressly waive recourse to ordinary courts for the resolution of such disputes.
